Terms & Conditions

These Terms and Conditions govern the Boredom's End mobile app.

By downloading, installing, or using the Boredom's End mobile application ("the App," "we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Kris Makes Games.

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

Boredom's End is an entertainment application that randomly selects activity suggestions from a curated list based on a user-selected mood and risk preference. The App suggests activities; it does not supervise, verify, or guarantee the safety, legality, or suitability of any suggested activity for any individual user or situation.

3. Eligibility

You must be at least 13 years of age to use this App. If you are between 13 and 18 years of age (or the age of legal majority in your jurisdiction, if different), you represent that you have your parent or legal guardian's permission to use the App and that they have reviewed these Terms.

4. Assumption of Risk

This section is important. Please read it carefully.

The App suggests activities across a range of risk levels, which you select ("Mellow," "Adventurous," and "Reckless"). Activities at higher risk tiers may include, but are not limited to, physical exertion, climbing, use of fire, operation of vehicles, interaction with strangers, and other activities that carry an inherent risk of physical injury, property damage, emotional discomfort, or legal consequence.

By using this App, you acknowledge and agree that:

  • You are solely responsible for evaluating whether any suggested activity is safe, legal, and appropriate for you, your physical condition, your location, and your circumstances at the time.
  • The App does not know your surroundings, physical capabilities, medical conditions, local laws, or the context you are in. A suggestion is not an instruction, and you are free to skip, modify, or decline any suggested activity at any time.
  • You assume all risk associated with performing any activity suggested by the App, including risk of injury, death, property damage, arrest, or civil liability.
  • Activities suggested at the "Reckless" risk tier are explicitly flagged as carrying a heightened risk of injury, and your acknowledgment of that risk is a condition of accessing that tier.
  • Some suggested activities may involve other people (friends, strangers, or the public). You are responsible for obtaining any necessary consent and for the consequences of involving others in an activity.

5. No Professional Advice

Nothing in the App constitutes medical, legal, safety, or professional advice of any kind. Suggested activities are provided for entertainment purposes only.

6. User Conduct

You agree not to:

  • Use the App to plan or engage in any illegal activity
  • Use the App in a way that endangers minors or other individuals without their informed consent
  • Attempt to reverse-engineer, decompile, or extract the App's source code or activity database for commercial redistribution
  • Use the App in any manner that could damage, disable, or impair its functioning for other users

7. Intellectual Property

All content within the App, including but not limited to the activity list, app design, graphics, logos, and underlying software, is the property of Kris Makes Games, unless otherwise noted, and is protected by applicable copyright and intellectual property laws. You may not copy, distribute, or create derivative works from App content without prior written permission.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT ACTIVITY SUGGESTIONS WILL BE SAFE OR SUITABLE FOR ANY PARTICULAR USER.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KRIS MAKES GAMES AND ITS DEVELOPERS, OFFICERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP OR ANY ACTIVITY SUGGESTED BY THE APP — INCLUDING, WITHOUT LIMITATION, PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF THE APP EXCEED THE AMOUNT YOU PAID, IF ANY, TO ACCESS THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (OR, IF THE APP IS FREE, TEN U.S. DOLLARS ($10.00)).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Kris Makes Games and its developers, officers, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the App; (b) your performance of any suggested activity; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

11. Location and Third-Party Services

If the App includes features that access your device's location or query third-party services (such as suggesting nearby restaurants), you acknowledge that such features depend on third-party data and services outside of our control, and we are not responsible for the accuracy, availability, or consequences of relying on that data.

12. Modifications to the App and Terms

We reserve the right to modify, suspend, or discontinue the App, in whole or in part, at any time without notice. We may also update these Terms from time to time. Continued use of the App after changes to these Terms constitutes your acceptance of the revised Terms. Material changes will be reflected in the "Last Updated" date above.

13. Termination

We reserve the right to suspend or terminate your access to the App at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee without regard to its conflict of law principles, unless otherwise required by applicable consumer protection law in your jurisdiction.

15. Dispute Resolution

Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through informal negotiation. If informal negotiation fails, the dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court, except that either party may bring an individual claim in small claims court.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kris Makes Games regarding the App and supersede any prior agreements.
