Terms & Privacy Policy

Welcome to Kitten-Dex ("the App," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Kitten-Dex mobile application. By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement. If you are under the age of majority in your jurisdiction, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

2. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized access to your account. We are not liable for any loss arising from your failure to safeguard your credentials.

3. User-Generated Content

The App allows you to upload photographs, notes, location data, and other content ("User Content") associated with cats you observe.

3.1 Ownership. You retain ownership of your User Content. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and transmit that content solely for the purpose of operating and providing the App's features, including the community feed.

3.2 Your responsibility for content. You are solely responsible for the photos, notes, and other material you upload. You represent that you have the right to upload such content and that it does not violate any law or the rights of any third party.

3.3 Prohibited content. You agree not to upload content that is illegal, obscene, abusive, harassing, infringing, or that depicts anything other than its intended subject matter (cats and related observations). We reserve the right, but not the obligation, to review, remove, or restrict access to any User Content at our sole discretion, with or without notice.

3.4 No liability for user content. We do not pre-screen User Content and are not responsible or liable for any content uploaded by users, including but not limited to inappropriate, offensive, or unlawful photos or notes. We disclaim all liability arising from User Content uploaded by any user, including content shared via the community feed and viewed by other users.

3.5 Reporting. If you encounter content that violates these Terms, contact us at [email protected] so we can review it.

4. Privacy and Data

4.1 We do not sell your data. We do not sell, rent, or trade your personal information or User Content to third parties for marketing or any other purpose.

4.2 What we collect. The App collects account information (username, email, password — stored as a secure hash), photos you upload, location coordinates associated with sightings you log, and basic usage data necessary to operate the App.

4.3 How we use it. Your data is used solely to provide the App's functionality, including your personal cat catalog, the community feed (for content you choose to share), and statistics about your activity within the App.

4.4 Location data. Sightings may include GPS coordinates you choose to attach. This data is visible to you and, if you share a cat to the community feed, may be visible to other users who interact with that shared content. You control whether to attach location data to a sighting.

4.5 Data storage. Data is stored on infrastructure we control. While we take reasonable measures to protect your data, no method of electronic storage is completely secure, and we cannot guarantee absolute security.

4.6 Account deletion. You may request deletion of your account and associated data by contacting [email protected]. We will remove your data within a reasonable timeframe, except where retention is required by law.

5. Community Feed

Content you mark as "shared" becomes visible to other users of the App and may be added to other users' personal catalogs ("collected"). Once another user collects shared content, a copy exists independently in their account, and removing your share does not retract previously collected copies. Exercise discretion when choosing to share content publicly within the App.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Upload content that infringes on the rights, privacy, or safety of any person or animal
• Attempt to gain unauthorized access to other accounts or App infrastructure
• Use automated means (bots, scrapers) to access or interact with the App without our prior written consent
• Harass, impersonate, or misrepresent your identity to other users
• Misuse the sighting or leveling mechanics, including artificially manipulating location data, timestamps, or stat values

We reserve the right to suspend or terminate accounts that violate these Terms.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DATA WILL NOT BE LOST.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

• Content uploaded by you or any other user, including photos, notes, or shared community content
• Loss or corruption of your data, including cats, sightings, or photos
• Unauthorized access to or alteration of your data
• Interactions between users facilitated by the App, including the community feed and sharing features
• Any reliance on stats, levels, or other in-app mechanics

OUR TOTAL LIABILITY ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US, IF ANY, IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless Kris Makes Games and its developer(s) from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App, your User Content, or your violation of these Terms or any third-party rights.

10. Third-Party Services

The App may use third-party services for functionality such as mapping (OpenStreetMap), location services, or future advertising integrations. Your use of those features is also subject to the respective third party's terms and privacy practices, which we do not control.

11. Modifications to the App and Terms

We may modify, suspend, or discontinue the App, in whole or in part, at any time without liability. We may revise these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised Terms. We will make reasonable efforts to notify users of material changes.

12. Termination

We may suspend or terminate your access to the App at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the App ceases immediately.

13. Governing Law

These Terms are governed by the laws of Tennessee, USA, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Tennessee, USA.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
